A vocal opponent of the Pretrial Fairness Act can now use the law to confine a defendant who was released pretrial under the old cash bail system.

The Edwardsville Intelligencer reports that a Troy man accused of shooting a woman to death earlier this month posted $100,000 bail and was released from jail 72 hours later.

The Pretrial Fairness Act requires that a judge hold a detention hearing where the Madison County state’s attorney, who challenged the new law in court, will be tasked with arguing he should not be rereleased.

Defendant Michael S. Perham is charged with first-degree murder in the shooting of his girlfriend. She was allegedly shot multiple times, including at least twice in the back.
