Illinois Supreme Court now to take time in deciding constitutionality of Pretrial Fairness Act

The Illinois Supreme Court has heard oral arguments on whether the new state law ending cash bail in Illinois is constitutional – but there’s no word yet on when the high court will rule.

The Pretrial Fairness Act remains on hold as the court fight continues.

A number of state attorneys say the law improperly limits a judge’s discretion in setting bail, but the attorney general’s office argues that the legislature has the authority to set such rules.
