Spencer Elden appeared as a child swimming on the iconic album cover for Nirvana’s generation-forming ‘Nevermind’ and embraced the pop culture standing with a tattoo and even recreated the photo several times later in his life. For some reason, Elden now a 30-year-old adult, felt the need to sue the band for hundreds of thousands of dollars. Well, Variety reports that a judge in Central California dismissed the case weeks after lawyers for Nirvana sought to get the case tossed out, and Elden’s legal team failed to file an opposition before December.

Celebrate this triumph over BS by checking this recently unearthed bootleg video of Nirvana performing in Boise,Idaho. The sound and video quality are quite rough, but it definitely plays into the wild frantic nature of the band at the time. Watch the full set above.
